TERMS AND CONDITIONS

The present online shop, www.maekotessuti.com is managed by MAEKO S.r.l. - Via Nocchette, 24 - 13854 Quaregna Cerreto (BI) - VAT NUMBER 10487960964 which assumes the capacity of “seller” in the contract of sale concerning the products purchased by you.

The sales contract concluded by you through this online shop is governed by Italian law. These general terms and conditions (and in particular those published at the time the order is placed) shall apply exclusively to the sale made through this online shop, taking into account the aforementioned provisions.

1 - Orders - Invoicing

1.1 All purchase orders for Products transmitted to MAEKO must be complete in all their parts and must contain all the elements necessary for the correct identification of the Products ordered. Each order for Products transmitted to MAEKO constitutes a contractual proposal from the Customer and, therefore, will only be binding for MAEKO if confirmed for acceptance by the same. Fulfillment of the order by MAEKO shall be equivalent to confirmation and acceptance thereof.

1.2 MAEKO reserves the right not to accept incomplete orders that have not been duly completed. In the event of non-execution of the order by MAEKO (if the same is due to the unavailability of the Products ordered by the Customer) MAEKO will inform the Customer as soon as possible and refund any sums already paid by the latter in respect of the non-executed supply. In this case, the Customer will not be entitled to any refund or compensation of any kind.

1.3 The tax documentation relating to the ordered Products will be issued by MAEKO when the Products are shipped to the Customer. If the Customer has a VAT number and wishes to receive an invoice in his own name, he must indicate his VAT number with all his details at the time of registration. Failing this, MAEKO will not issue a tax invoice.

1.4 The electronic invoicing service to P.A. is active.

2- Prices

2.1 Unless otherwise indicated, the prices of the Products published by MAEKO shall be deemed to include VAT. The prices of the Products published by MAEKO from time to time cancel and replace the previous ones and are subject to the actual availability of the Products.

 3 3 - Colour variations and fabric samples

3.1 MAEKO accepts no liability for any colour discrepancies between the photos shown on the Internet viewed from any monitor and the goods delivered.

MAEKO RECOMMENDS ORDERING SAMPLES BEFORE PURCHASING CUT-TO-SIZE FABRICS.

4 – Product delivery

4.1 All delivery costs of the Products are charged to the Customer.
Deliveries are made by couriers upon receipt of payment for the order and in any case no later than 14 working days.

4.2 The delivery terms indicated by MAEKO refer to the Products present in its warehouses and, although carefully evaluated, are not binding for MAEKO, which may subsequently confirm or modify them, depending on its actual needs.
Delays in deliveries of less than 30 (thirty) days do not entitle the Customer to refuse the delivery of the Products, nor to claim compensation or indemnity of any kind.

4.3 In the case of purchase of products available on order MAEKO informs you that delivery may vary from 15 (fifteen) to 60 (sixty) working days, subject to production times.

5 - Warranty

5.1 MAEKO guarantees only the physical integrity of the Products at the time of delivery.

Maeko carefully checks the products before they leave the warehouse, but nevertheless reminds customers that, as they are NATURAL FIBRE FABRICS, certain imperfections or irregularities are guaranteed characteristics of the product's originality.

MAEKO reminds you that fabrics must be checked before being cut and made up, because in that case, even if there are manufacturing defects, they cannot be returned.

5.2 Without prejudice to Article 5.1 above, MAEKO makes no warranty as to the compatibility of the Products with other products or equipment used by the Customer, makes no warranty as to the suitability of the Products for the specific use intended by the Customer.

6 - The transport of returns is always the responsibility of the customer and should be sent to MAEKO S.r.l. - Via Nocchette, 24 - 13854 Quaregna Cerreto (BI).
Returned products may be accepted by MAEKO only if perfectly intact and free of any signs of use, and returned in their original packaging and/or wrapping.

C.O.D. packages will not be accepted.

6.1 The customer has a right of withdrawal and may only return an item if it does not fall under the categories listed in 6.2.

If the return is due to an error on the part of MAEKO or a quality issue with the item, MAEKO will cover the shipping costs for the return.

6.2 The right of withdrawal does not apply to fabrics ordered by the metre. Fabrics cut specifically for the customer are considered custom-made products. Furthermore, returns cannot be made for ‘mystery packs’, i.e. packages with surprise contents that contain items on offer at prices far below the list prices, remnants of remnants, yarns or other items of our production.

The provisions relating to liability for defective products (Article 5.1), for which MAEKO undertakes to promptly replace the product, bearing the shipping costs necessary to replace the product, remain unaffected.

In this case, MAEKO requests that you send an email to info@maekotessuti.com within 10 working days of receiving the order, attaching one or more photos of the defect found.

Upon receipt, you will be contacted promptly to determine the terms of the return.

Once the product has been received, the defect has been checked and the integrity verified MAEKO, in agreement with you, will provide in the shortest possible time to the replacement of the new product. If the product is not available, you will be refunded what you paid for it.

6.3 Refund procedure
Once the return has been received and checked, Maeko S.r.l. will inform the customer by e-mail whether the refund has been approved or rejected. If the refund is approved, it will be processed and credited to the original payment method within a few working days.

6.4 NOT INCLUDED IN THE CATEGORIES FOR WHICH THE RIGHT OF WITHDRAWAL IS POSSIBLE ARE FABRICS ORDERED BY THE METER. FABRICS CUT SPECIFICALLY FOR YOU ARE CONSIDERED CUSTOM-MADE PRODUCTS.

The provisions relating to liability for defective products (Article 5.1), for which MAEKO undertakes to promptly replace the product, bearing the shipping costs necessary to replace the product, remain unaffected.

In this case, MAEKO requests that you send a communication by e-mail to info@maekotessuti.com, enclosing one or more photos of the defect detected, within 10 (ten) working days of receipt of the fabrics.

Upon receipt, you will be contacted promptly to determine the terms of the return.

Once the product has been received, the defect found by you has been checked and the integrity has been verified MAEKO, in agreement with you, will deliver the new product as soon as possible.
If the product is not immediately available MAEKO will contact you to give you the delivery date, if you are not willing to accept it, you will be reimbursed what you have paid (as indicated in the receipt/invoice) withholding the amount of the initial shipping costs, which will remain definitively at the expense of the Customer.

Without prejudice to the possible applicability of mandatory provisions of law for the protection of consumers (as defined pursuant to Article 1 letter b) of Legislative Decree No. 185 of 22 May 1999), any dispute in any way connected to these General Conditions shall be devolved to the exclusive jurisdiction of the Court of Milan. Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the Customer declares that he/she has carefully read and understood and specifically accepts the following clauses of the General Conditions of Sale MAEKO: 1.1,1.2,1.3 - 2.1 - 3.1 - 4.1,4.2,4.3 - 5.1,5.2,5.3 - 6 - 6.1,6.2,6.3

7- Payment Methods

Customer may choose one of the following prepayment methods:

Please note that depending on the agreement with your credit institution, you may be charged additional fees for the use of your chosen payment instrument.

8 – Shipping costs

The products will be delivered by express courier to the address indicated by the CUSTOMER when placing the order within and no later than 10 days from the date of receipt by the CUSTOMER of the order confirmation e-mail sent by MAEKO Srl.
The standard delivery time, in case of availability of the products ordered by the CUSTOMER, is 24/48h. MAEKO Srl cannot be held responsible for delays in delivery attributable to the courier (e.g. strikes, overloading).

The cost of a standard shipment within 15kg is €10.00.

You can benefit from free standard delivery in Italy by purchasing at least 99€ of products.

For orders weighing close to 100kg, it is also possible to request a quote for shipping by truck courier.
For orders heavier than 100kg, we always recommend requesting a quote for shipping costs from amministrazione@maekotessuti.com, as the actual costs may vary depending on the total weight of the order.
The CUSTOMER has the option of using his own freight collect courier or concluding the order without requesting a cost estimate.
